Welcome to Breathe Free Clinic’s website. By clicking, accessing and registering for our services on www.breathefreeclinic.co.nz you agree to be bound by these Terms and Conditions (Terms), and our Privacy Policy.
It is important to know that this contract is between you (the “Client”) and Breathe Free Clinic (“we” or “us” or “the Clinic”)and governs your relationship, use and access to the services on our website.
This Breathe Free website (the Site) and all the materials available on the Site are the property of Breathe Free Clinic and/or our affiliates, and are protected by copyright, trademark, and other New Zealand and International intellectual property laws. The Site is provided solely for your personal noncommercial use and as intended by Breathe Free Clinic.
Nothing contained on our Site or payment for courses and printable resources should be construed as granting the right to use any trade names, trademarks, service marks or logos without the express prior written consent of Breathe Free Clinic or the respective owner of the marks.
You may not edit or use the Site or the materials available on the Site in a manner that constitutes an infringement of our rights or that has not been authorized by us. If you share our content via social media, we ask that your postings clearly acknowledge us as the source.
You acknowledge that Breathe Free Clinic has the right but not the obligation to use and display any postings or contributions of any kind and that Breathe Free Clinic may elect to cease the use and display of any such materials (or any portion thereof), at any time for any reason whatsoever.
The Client is liable for any costs that may arise from a breach of any copyright or licensing agreement with Breathe Free Clinic.
Breathe Free Clinic is not a Registered Medical Service Provider and does not represent itself as such. It makes no claims as to the Client’s eventual outcome other than those based on it’s observations and experience in this field of expertise. The Clinic does however accept referrals from Registered Medical Service Providers as this arises.
If the Breathe Free Clinic believes it is in the best interests of a Client to seek help from a registered medical practitioner or qualified integrative health practitioner, it will advise the Client to do so.
Breathe Free Clinic carries out breathing assessments and offers an experiential educational course designed to significantly improve a Client’s breathing function through visual, written and verbal instruction and coaching.
Improvements to a Client’s breathing function is dependent on the Client participating in the full course and carrying out practice each day as instructed and shown on the course. Whilst the Clinic will do it’s best to teach, encourage and coach a Client, it is the responsibility of the Client to complete the course and follow instructions for practice of the breathing techniques taught, whilst also keeping records for their practitioner to assess.
Breathe Free Clinic reserves the right to withdraw any group course participant who:
In either case they will be given written notice of withdrawal from the course without return of fees paid. Breathe Free Clinic has no liability for any losses or damages from such action.
Following a Breathing Assessment and once enrolled in a Breathe Free Clinic course, the Client agrees to attend all of the in-clinic course sessions in sequence and to complete all of the practice recommended as best as is practicable.
The Client acknowledges that they are engaging the services of Breathe Free Clinic of their own volition and agree to abide by all the Terms and Conditions in this agreement. The Client agrees that they understand that Breathe Free Clinic offers a course of remedial and educational advice and are not representing themselves as registered medical practitioners.
Fees for Breathe Free Clinic’s services are included on this website. These may change from time to time and whilst we will endeavour to keep these updated, they will not be considered binding.
Should bookings be made through phone or email contact with Breathe Free Clinic and not through the website, is up to the Client to ensure they understand and have agreed on the fees to be paid at the time of booking.
Full payment is due at the time of a consultation and/or start of a breathing course at the Clinic.
Any bookings made online will require payment at the time of booking.
This is non-refundable even if a Client fails to attend any or all of the course sessions on the dates booked, unless at Breathe Free Clinic’s sole discretion, it is deemed fair and reasonable to do so, for example in the case of a medical emergency.
At the discretion of the Clinic, a payment plan may be arranged prior to the Breathe Free Course beginning however the fee is owed in full whether a Client completes a course or not.
If unable to attend the course in full, a Client may arrange to attend the session/s they missed on a subsequent course being run at Breathe Free Clinic within 6 months of their initial course start.
Payment can be made using cash, bank transfer, or any other method as agreed to between the Clinic
and the Client.
It is our policy that all transactions on our site are final due to the nature of services being provided. However, you may cancel your assessment or course booking at any time by either giving us a call or emailing our office. We will acknowledge your cancellation request/notice within two working days of receipt.
If you cancel more than one month before the start of your course then you will receive a full refund, less $10 to cover our administration costs. If you cancel less than one month before the start of your course then no refund will be given. However, under exceptional circumstances at the discretion of the Clinic, we can offer a full refund up until the day before the start date of your course.
We require a minimum number of participants to run our courses. If for any reason these numbers are not reached, then Breathe Free Clinic reserves the right to cancel the course. In this instance, we will either offer you a place on another course or we will give you a full refund.
Interest will be charged on all invoices overdue by one month. It will be charged at a rate of 2.5%, compounding per calendar month until payment is made in full.
If a Client defaults on payment of any invoice when due, the Client agrees to cover any and all costs and disbursements that Breathe Free Clinic needs to pay in order to recover costs, including engagement of a solicitor or any nominee Breathe Free Clinic sees fit to engage for collection of such fees and costs.
Breathe Free Clinic will keep confidential any personal information obtained in the course of providing it’s services to Clients and will not release that information to any third party without the express written permission of the Client or unless required to do so by law. (see also Breathe Free Clinic’s Privacy Policy)
Breathe Free Clinic shall not be liable for errors or omissions arising from oversight or a misinterpretation of the Client’s verbal instruction or practice.
If for any reason we need to cancel your course or a session of your course, we will notify you as soon as possible. Whilst cancellation of a course or a session of your course will likely not occur, if this ever happens, the Clinic will always do it’s best to offer you a make-up session or an alternative course.
We understand there may be valid reasons that you are unable to attend a session or even the entire course. For everyone to know what they are doing, we need you to give us plenty of notice, ie 48 hours or more, if you are unable to attend one or more sessions or all of your course.
Our courses can be popular and at times we have people on waiting lists. If you are unable to attend more than two sessions of any one course, you will be advised to re-book for another course date, where you can attend all of the sessions within the time frame and sequence recommended by Breathe Free Clinic. If you have already paid or begun the course you will need to attend the catch up sessions or course within 6 months of payment.
Failure to show up for a consult or course session without cancellation of more than 12 hours notice and unless due to an emergency, will incur a fee of $100 (GST incl).

Breathe Free has the exclusive right to make changes to these Terms occasionally and shall inform the user of such or any changes made to these Terms.
Notification of users may be by posting the modified Terms on our website inclusive of the “last revised date” or “last updated” which indicates when the Terms were last revised or updated. Where such changes have been made and you continue to use the service after being notified of the changes, such usage will constitute an acceptance of the revised Terms.
We may, at any time and without liability, adjust or discontinue all or part of the Service; charge, modify or waive any fees required to use the Service; or offer opportunities to some or all Service users.
